Clover Conceptions ("we," "us," or "our") is committed to protecting the privacy and sensitivity of the information shared by our Intended Parents, Surrogates, and Egg Donors. This Privacy Policy describes how we collect, use, and safeguard your information in compliance with the California Consumer Privacy Act (CCPA), the California Privacy Rights Act (CPRA), and federal HIPAA standards where applicable.
1. NOTICE AT COLLECTION: INFORMATION WE COLLECT
In the course of our surrogacy and egg donation services, Clover Conceptions collects the following categories of Personal Information (PI) and Sensitive Personal Information (SPI):
Identifiers: Name, alias, address, email, phone number, Social Security Number, and Passport details.
Sensitive Personal Information: Medical records, genetic testing results, mental health evaluations, and racial/ethnic origin.
Financial Information: Bank account details and financial statements for escrow and reimbursement purposes.
Biometric & Physical Characteristics: Photos, DNA data, and family medical history for matching purposes.
2. HOW WE USE YOUR INFORMATION
We process your data strictly for the following business purposes:
Matching Services: Facilitating the introduction and matching of Intended Parents with Surrogates or Donors.
Coordination of Medical Care: Sharing necessary health data with IVF clinics, labs, and psychologists.
Legal & Insurance Facilitation: Coordinating with attorneys and insurance providers to secure legal contracts and health coverage.
Regulatory Compliance: Meeting legal obligations under California law regarding surrogacy arrangements.
3. DISCLOSURE AND SHARING OF DATA
No Sale of Data: Clover Conceptions does not sell your personal information.
Service Providers: We share information with third-party professionals (e.g., IVF specialists, attorneys, escrow agents) only as necessary to fulfill your surrogacy or donation journey.
Reproductive Health Protection: In compliance with California AB 1242, we do not disclose private reproductive health information to out-of-state law enforcement seeking to penalize lawful reproductive care.
4. YOUR CALIFORNIA PRIVACY RIGHTS (CCPA/CPRA)
As a California resident, you have the following specific rights:
Right to Access: You may request a copy of the specific pieces of PI we have collected about you.
Right to Deletion: You may request that we delete your PI, subject to medical record retention laws.
Right to Correct: You may request that we rectify inaccurate information.
Right to Limit Use of Sensitive PI: You may request that we restrict the use of your health or genetic data to only what is essential for our services.
5. DATA SECURITY & RETENTION
We implement high-level security measures, including encryption and restricted access protocols, to protect your "Protected Health Information" (PHI). We retain records in accordance with California’s medical record retention requirements and relevant statutes of limitations for legal contracts.
